Terms of Service

Welcome to RadarPress. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and RadarPress LLC ("RadarPress", "Company", "we", "our", "us") governing your access to and use of the RadarPress website, dashboard, APIs, and all related services (collectively, the "Service").

⚠️ Important: By creating an account, connecting your YouTube channel, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1 Definitions

For the purposes of these Terms, the following definitions apply:

"Account" means the unique account created for you to access and use the Service.

"Analytics Data" means the insights, metrics, sentiment analysis, and other data generated by RadarPress through processing of Public YouTube Data.

"AI Processing" means the use of artificial intelligence and machine learning technologies, including but not limited to natural language processing models, to analyze and derive insights from data.

"Content" means any text, graphics, images, data, or other materials uploaded, submitted, or displayed through the Service.

"Public YouTube Data" means publicly available information from YouTube, including but not limited to video metadata (titles, descriptions, tags, thumbnails), public comments, view counts, like counts, and other publicly visible engagement metrics.

"Subscription" means a paid or trial subscription to access premium features of the Service, including DEMO (free trial) and PRO (paid) plans.

"User Data" means any personal information or data you provide to RadarPress, including information obtained through Google OAuth authentication.

2 Acceptance of Terms

2.1 Agreement to Terms. By accessing or using the Service, you confirm that you can form a binding contract with RadarPress, that you accept these Terms and agree to comply with them, and that you are not a person barred from using the Service under the laws of the United States or any other applicable jurisdiction.

2.2 Updates to Terms. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, providing additional notice (such as via email or through the Service interface). Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

2.3 Additional Terms. Certain features of the Service may be subject to additional terms and conditions, which will be presented to you when you access those features. Such additional terms supplement and are incorporated into these Terms.

3 Description of Service

3.1 Platform Overview. RadarPress is a software-as-a-service (SaaS) analytics platform that provides YouTube content creators with AI-powered sentiment analysis, audience insights, and performance metrics derived from publicly available YouTube data.

3.2 Core Features. The Service includes, but is not limited to:

  • Sentiment Analysis: AI-powered analysis of public comments to determine audience sentiment (positive, negative, neutral, toxic)
  • Comment Categorization: Automatic classification of comments into relevant topics and categories
  • Performance Metrics: Tracking and visualization of video engagement statistics over time
  • Trend Detection: Identification of emerging patterns in audience feedback and engagement
  • AI-Generated Insights: Automated recommendations and observations based on data analysis
  • Keyword Extraction: Identification of frequently mentioned topics and themes in comments
  • Alert Systems: Notifications for significant changes in sentiment or engagement patterns

3.3 Read-Only Access. RadarPress operates exclusively with read-only access to your YouTube data. We do not upload, modify, delete, or otherwise alter any content on your YouTube channel. We cannot post comments, change video settings, or access private analytics or revenue data.

3.4 Data Processing. All analytics and insights are derived from publicly available YouTube data. Our AI systems process this public data to generate actionable insights for content creators.

4 Eligibility

4.1 Age Requirements. You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service and they must agree to these Terms on your behalf.

4.2 Capacity. You represent and warrant that you have the legal capacity to enter into these Terms in your jurisdiction.

4.3 Channel Ownership. You represent and warrant that you are the owner or authorized manager of any YouTube channel you connect to the Service. You may not connect channels belonging to others without their explicit authorization.

4.4 Compliance with Laws. You agree to use the Service only in compliance with all applicable local, state, national, and international laws and regulations.

5 Account Registration & Security

5.1 Account Creation. To access most features of the Service, you must create an Account by signing in with your Google account and connecting a YouTube channel. We do not collect or store passwords.

5.2 Accurate Information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

5.3 Account Security. You are responsible for:

  • Maintaining the security of your Google account credentials
  • All activities that occur under your Account
  • Immediately notifying us of any unauthorized access or security breach
  • Ensuring that your devices used to access the Service are secure

5.4 One Account Per Channel. Each YouTube channel may only be connected to one RadarPress Account at a time. Attempting to connect the same channel to multiple accounts may result in suspension or termination.

5.5 Revoking Access. You may disconnect your YouTube channel and revoke RadarPress's access at any time through your Google Account permissions settings at myaccount.google.com/permissions.

6 Google OAuth & YouTube API Usage

6.1 OAuth Scopes. RadarPress uses Google OAuth 2.0 with the following limited scopes:

• email

• profile

• https://www.googleapis.com/auth/youtube.readonly

6.2 Permitted Actions. These permissions allow RadarPress to:

  • Verify your identity and authenticate your account
  • Confirm ownership or management rights over connected YouTube channels
  • Access publicly available data from your YouTube channel for analytics purposes

6.3 Prohibited Actions. RadarPress explicitly DOES NOT and CANNOT:

  • Upload, edit, or delete videos or other content
  • Post, modify, or delete comments
  • Modify channel settings, branding, or monetization
  • Access private YouTube Analytics or revenue data
  • Access private videos or playlists
  • Subscribe, like, or perform any action on your behalf

6.4 Platform Compliance. Your use of the Service is also subject to:

6.5 Token Management. OAuth tokens are securely stored using industry-standard encryption. Tokens are automatically refreshed as needed and immediately invalidated upon account disconnection or deletion.

7 AI & Machine Learning Processing

7.1 AI-Powered Analysis. RadarPress utilizes artificial intelligence and machine learning technologies to provide sentiment analysis and insights. By using the Service, you acknowledge and consent to AI processing of public YouTube data associated with your connected channel.

7.2 Technology Stack. Our AI processing includes:

  • Natural Language Processing (NLP): For comment analysis, sentiment detection, and keyword extraction
  • Machine Learning Models: Including transformer-based models for text classification and sentiment analysis
  • Large Language Models (LLMs): For generating insights, summaries, and recommendations

7.3 Accuracy Disclaimer. While we strive for high accuracy in our AI analysis, you acknowledge that:

  • AI-generated insights are probabilistic and may not always be 100% accurate
  • Sentiment analysis may occasionally misinterpret sarcasm, context, or nuanced language
  • Results should be used as supplementary information, not as the sole basis for business decisions
  • AI models are continuously improved, which may result in variations in analysis over time

7.4 No Training on Your Data. RadarPress does not use your channel's specific data to train our core AI models. Your data is processed for analysis purposes only and is not shared with third-party AI providers for model training.

7.5 Human Review. Certain features may involve human review for quality assurance and model improvement. Any such review is conducted under strict confidentiality obligations.

8 Subscription Plans & Payments

8.1 Available Plans. RadarPress offers the following subscription tiers:

DEMO (Free Trial)

  • • 7-day trial period
  • • Up to 50 videos tracked
  • • Limited daily AI insights
  • • Basic sentiment analysis
  • • No credit card required

PRO ($20/month)

  • • Up to 500 videos tracked
  • • Unlimited AI insights
  • • Advanced sentiment analysis
  • • Priority data processing
  • • Priority support

8.2 Payment Processing. All payments are processed exclusively by Stripe, Inc. RadarPress does NOT collect, store, or have access to your credit card numbers, CVV, billing address, or any other payment details. When you subscribe, you are redirected to Stripe's secure checkout. We only receive basic subscription information (plan type, status, renewal date) via Stripe's API to display your account status.

8.3 Billing Cycle. PRO subscriptions are billed monthly in advance. Your subscription will automatically renew at the end of each billing cycle unless cancelled.

8.4 Price Changes. We reserve the right to modify subscription prices. Any price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle.

8.5 Cancellation. You may cancel your subscription at any time through your account settings or billing portal. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • No prorated refunds will be issued for partial months
  • Your account will automatically revert to limited functionality after the paid period ends

8.6 Refund Policy. All subscription fees are generally non-refundable once charged. However, we may provide refunds at our sole discretion in cases of:

  • Technical issues preventing service access for extended periods
  • Duplicate or erroneous charges
  • First-time subscribers within 48 hours of initial payment

8.7 Failed Payments. If a payment fails, we will attempt to process it again and may notify you via email. Continued payment failure may result in suspension or downgrade of your account.

9 Acceptable Use Policy

9.1 Permitted Use. You may use the Service only for lawful purposes and in accordance with these Terms. The Service is intended for YouTube content creators seeking to understand and improve their audience engagement.

9.2 Prohibited Activities. You agree NOT to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Infringe upon the rights of others, including privacy, intellectual property, and publicity rights
  • Connect YouTube channels you do not own or have authorization to manage
  • Use the Service to harass, stalk, or harm other individuals
  • Attempt to probe, scan, or test the vulnerability of the Service or any related system
  • Attempt to circumvent any security measures or access controls
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service without authorization
  • Resell, redistribute, sublicense, or commercially exploit the Service without written permission
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Transmit any malware, viruses, or other malicious code
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service in any manner that could damage, disable, or impair the Service

9.3 Rate Limits & Fair Use. The Service is subject to rate limits and fair use policies to ensure quality for all users. Excessive usage that impacts other users or system stability may result in temporary throttling or account restrictions.

9.4 Monitoring. We reserve the right to monitor usage patterns to detect violations of this Acceptable Use Policy and take appropriate action, including suspension or termination.

10 Intellectual Property Rights

10.1 RadarPress Property. The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of RadarPress LLC and its licensors. This includes:

  • All software, algorithms, and AI models
  • The RadarPress name, logo, and all related trademarks
  • Dashboard designs, user interface, and visual elements
  • Documentation, marketing materials, and website content
  • Aggregated and anonymized analytics methodologies

10.2 Your Content. You retain all ownership rights to your YouTube content. By connecting your channel, you grant RadarPress a limited, non-exclusive, royalty-free license to access and process publicly available data from your channel solely for the purpose of providing the Service.

10.3 Analytics Data Ownership. Analytics Data generated by RadarPress based on your channel's public data is provided to you under license for your personal or business use. RadarPress retains ownership of aggregated, anonymized insights derived from collective user data.

10.4 Feedback. If you provide suggestions, feedback, or ideas about the Service ("Feedback"), you grant RadarPress an unrestricted, perpetual, irrevocable, royalty-free license to use such Feedback for any purpose without compensation or attribution.

10.5 DMCA Compliance. RadarPress respects intellectual property rights. If you believe content accessible through the Service infringes your copyright, please contact us at [email protected] with:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

11 Third-Party Services

11.1 Integration with Third Parties. The Service integrates with and relies on third-party services, including but not limited to:

  • Google/YouTube: For authentication and data access
  • Stripe: For payment processing
  • Cloud Infrastructure Providers: For hosting and data storage
  • AI Service Providers: For machine learning processing

11.2 Third-Party Terms. Your use of third-party services through RadarPress is subject to those services' respective terms and privacy policies. We encourage you to review them.

11.3 No Responsibility. RadarPress is not responsible for:

  • The availability, accuracy, or reliability of third-party services
  • Changes to third-party APIs, terms, or functionality
  • Any damages resulting from third-party service outages or limitations
  • Content, products, or services offered by third parties

11.4 API Changes. If YouTube, Google, or other critical third-party services make changes that affect the Service, we will make reasonable efforts to adapt. However, we cannot guarantee uninterrupted service in such cases.

12 Disclaimer of Warranties

PLEASE READ CAREFULLY

12.1 THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

12.2 RadarPress LLC, its subsidiaries, affiliates, and licensors do not warrant that:

  • The Service will function uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate, reliable, or complete
  • The quality of any analytics, insights, or information will meet your expectations
  • Any errors in the Service will be corrected
  • The Service will be compatible with all devices or systems

12.3 Any reliance on analytics, sentiment analysis, or AI-generated insights is at your own risk. You acknowledge that such information is for informational purposes only and should not be the sole basis for business or content decisions.

12.4 Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the exclusions will apply to the fullest extent permitted by applicable law.

13 Limitation of Liability

13.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RADARPRESS LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or data breach
  • Loss of goodwill or reputation
  • Cost of procurement of substitute services
  • Any other intangible losses

13.2 Liability Cap. IN NO EVENT SHALL RADARPRESS'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO RADARPRESS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13.3 THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF RADARPRESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.4 Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

14 Indemnification

14.1 You agree to defend, indemnify, and hold harmless RadarPress LLC, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your violation of any applicable law or regulation
  • Any content you provide or submit through the Service
  • Your connection of YouTube channels you were not authorized to connect

14.2 RadarPress reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

15 Termination

15.1 Termination by You. You may terminate your Account at any time by:

  • Disconnecting your YouTube channel from the Service
  • Revoking OAuth access via your Google Account settings
  • Contacting us to request account deletion

15.2 Termination by RadarPress. We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or the Acceptable Use Policy
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Requests from law enforcement or government agencies
  • Requirements imposed by YouTube, Google, or other platform providers
  • Technical or security issues
  • Extended periods of inactivity

15.3 Effect of Termination. Upon termination:

  • Your right to access and use the Service will immediately cease
  • We may delete your Account and associated data in accordance with our Privacy Policy
  • Any outstanding fees remain payable
  • Provisions that by their nature should survive termination will survive (including Sections 10, 12, 13, 14, and 16)

15.4 Data Export. Prior to termination, you may request an export of your Analytics Data. We will make reasonable efforts to provide such export in a standard format within 30 days of the request.

16 Dispute Resolution & Governing Law

16.1 Governing Law. These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

16.2 Informal Resolution. Before initiating any formal dispute resolution, you agree to first contact RadarPress at [email protected] and attempt to resolve the dispute informally for at least 30 days.

16.3 Arbitration Agreement. If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Broward County, Florida, unless otherwise agreed.

16.4 Class Action Waiver. YOU AND RADARPRESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16.5 Exceptions. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights pending arbitration.

16.6 Time Limitation. Any claim arising under these Terms must be brought within one (1) year after the cause of action arises, or such claim shall be permanently barred.

17 General Provisions

17.1 Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and RadarPress regarding the Service and supersede all prior agreements and understandings.

17.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17.3 Waiver. The failure of RadarPress to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by RadarPress.

17.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. RadarPress may assign these Terms without restriction.

17.5 Force Majeure. RadarPress shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, or failures of third-party services or infrastructure.

17.6 Notices. All notices to RadarPress must be sent to our contact email. We may provide notices to you via the email address associated with your Account or through the Service interface.

17.7 Headings. Section headings are for convenience only and shall not affect the interpretation of these Terms.

17.8 Language. These Terms were originally written in English. To the extent any translated version conflicts with the English version, the English version shall govern.
